LIMITATIONS
RAP does not apply if rented equipment is misused, abused, used negligently or operated outside of the terms of the rental agreement, the company or manufacturer’s guidelines, or normal operating procedures. Losses where RAP does not apply include but are not limited to:

Loss or damage resulting from overloading or exceeding the rated capacity.
Lack of lubrication or other normal servicing of equipment as required by the manufacturer or Company instructions or decals.
Loss or damage to tires, tubes, wheels and accessories such as hydraulic hoses, welding cables, saw blades, electric cord, LP tanks, etc.
Damage caused by using the wrong fuel – such as straight gas in diesel engines or vice versa.
Damage or cleanup costs from paint, mud, acid, sandblasting, welding, plastering, etc.
Damage caused by the customer during transportation – such as highway accidents or accidents occurring while hoisting or rigging equipment.
Damage resulting from saltwater corrosion.
Damage or loss caused by dishonesty of lessee’s employees or wrongful conversion by any person to whom the property has been entrusted by lessee.
RAP does not apply to the rental of cranes, boom trucks, boom lifts, aerial lifts of 120’ or larger, excavators, o-road articulating dump trucks, motor vehicles or other equipment identied to the customer at the time of rental.

PARAMETERS

Vandalism – customer must report vandalism to Mazzotta Rentals within 48 hours and provide proof of a filed police report.
Theft – customer is responsible for locking and securing rental equipment, including removing the key from the area in which the equipment is located.
Theft of rental equipment must be reported to Mazzotta Rentals within 48 hours and proof of filed police report is required.
Fire and smoke damage – does not apply to damage caused by negligence of the user.
Weather damage – includes damage from wind, hail, lightning and similar natural causes.
Accidental Damage – does not apply to damage caused by improper use by customer or customer’s subcontractor working under the direction of the customer.
